Note legali
Termini di licenza
Applies to the following products (“Software”): MindTheColor Pro 2.x, MindTheColor (base), MTC Density, MTC ChromaWarp, MTC Scope, MindTheColor v1.
1. Acceptance of Terms
By installing, downloading, activating, or using the Software — or by purchasing the product on Gumroad — you acknowledge that you have read and agree to this EULA. If you do not agree, do not install or use the Software.
2. Grant of License
Licensor grants you a non-exclusive, non-transferable, revocable license tied to your Adobe ID (a single Adobe license) for personal or internal business use. You may install on devices where you sign in with the same Adobe ID; simultaneous use by different persons is not permitted.
3. Permitted Use and Output
You may use the Software to produce final works and outputs (images, videos, projects, prints, client work, etc.), including commercial use, royalty-free. Rights in the outputs do not allow you to distribute, expose, or make the Software (or parts of it) available to third parties.
4. Restrictions
You shall not:
(a) sell, rent, lease, lend, distribute, transfer, or sublicense the Software to any third party;
(b) reverse engineer, decompile, or disassemble the Software, except as expressly permitted by law;
(c) modify the Software or create derivative works of the Software;
(d) remove or alter copyright, trademark, or other proprietary notices;
(e) use the Software to provide services that allow unlicensed third parties to access it (e.g., a SaaS exposing the plugin’s functionality);
(f) integrate, embed, or use the Software (or any of its parts, APIs, libraries, presets, or workflows) within, or for the benefit of, artificial intelligence or machine learning systems (including, by way of example, LLMs, generative models, training/validation pipelines, data labeling, autonomous agents, automations, orchestration tools), nor use the Software or its outputs to train, retrain, improve, or validate AI models, nor to create datasets intended for such purposes;
(g) allow AI systems/agents or bots to access or operate the Software (e.g., automations that simulate a human user to expose the Software’s functionality to others);
(h) bypass, circumvent, or interfere with license activation/verification mechanisms or any technical limitations of the Software.
Using the outputs created with the Software (images, layers, LUTs, final presets) in creative workflows that do not train or improve AI models is allowed. It remains prohibited to use the Software or its outputs to build datasets for training/validating AI models
5. Activation, Verification, and Connectivity
The Software requires an Internet connection for installation/activation and at each launch for license verification (via Gumroad and Licensor’s services). If connectivity is unavailable or services are unreachable, the Software may remain disabled until access is restored.
6. Updates and Upgrades
Minor updates and fixes may be provided at Licensor’s discretion. Major version upgrades (e.g., 2.x → 3.x) may require a new license. Features may vary as Adobe UXP evolves.
7. Third-Party Platform (Adobe UXP)
The Software is built on Adobe UXP; its operation depends on Adobe’s services and APIs. Licensor does not guarantee their availability and is not liable for interruptions or changes affecting the Software.
8. Intellectual Property
The Software is protected by copyright, trade secrets, and other IP rights of Licensor and/or its licensors. No ownership is transferred under this EULA.
9. Support
Support services, if any, are provided at Licensor’s discretion; any materials or code supplied as part of support are part of the Software and subject to this EULA.
10. Limitation of Liability
The Software is provided “as is” without warranties of any kind. To the extent permitted by law, Licensor shall not be liable for any direct, indirect, special, or consequential damages arising from use or inability to use the Software.
11. Indemnification
You agree to indemnify and hold Licensor harmless from claims, damages, liabilities, and costs (including attorneys’ fees) arising from your breach of this EULA.
12. Term and Termination
This EULA remains effective until terminated. Licensor may terminate immediately upon breach; you must cease use and destroy all copies upon termination.
13. Governing Law and Venue
This EULA is governed by Italian law. Exclusive venue: Rome, unless otherwise required by mandatory law.
14. Privacy
For licensing/verification, the Software may transmit limited data (e.g., license key, Gumroad email, technical identifiers) to verification services. See Licensor’s Privacy Notice for details.
15. Changes to Terms
Licensor may update this EULA by posting a new version on the official website; continued use constitutes acceptance of the changes.
Acceptance: by purchasing, downloading, installing, or using the Software, you acknowledge that you have read and fully agree to this EULA.
Accordo di Licenza Utente Finale (EULA) — MindTheColor
Valido per i seguenti prodotti (“Software”): MindTheColor Pro 2.x, MindTheColor (base), MTC Density, MTC ChromaWarp, MTC Scope, MindTheColor v1.
4. Restrizioni
È vietato:
(a) vendere, noleggiare, cedere, prestare, distribuire, trasferire o sublicenziare il Software a terzi;
(b) effettuare reverse engineering, decompilazione o disassemblaggio del Software, salvo quanto espressamente consentito dalla legge;
(c) modificare il Software o creare opere derivate del Software;
(d) rimuovere o alterare avvisi di copyright, marchi o altri avvisi proprietari;
(e) usare il Software per fornire servizi che permettano a terzi non licenziatari di utilizzarlo (ad es. un servizio SaaS che esponga funzionalità del plugin);
(f) integrare, incorporare o utilizzare il Software (o sue parti, API, librerie, preset, o flussi di lavoro) all’interno di, o a beneficio di, sistemi di intelligenza artificiale o di apprendimento automatico (inclusi, a titolo esemplificativo: LLM, modelli generativi, sistemi di addestramento/validazione, data labeling, agenti autonomi, automazioni, tool di orchestration) né utilizzare il Software o i suoi output per addestrare, ri-addestrare, migliorare o validare modelli di IA, né creare dataset destinati a tali scopi;
(g) consentire a sistemi di IA/agent o bot di accedere al Software o di pilotarlo (ad es. mediante automazioni che simulano un utente umano allo scopo di esporre le funzionalità del Software a terzi);
12. Durata e risoluzione
